Preamble
These Terms of Sale ("CGV") govern all purchases made on evamementos.com, operated by Chen Teboul, Entrepreneur Individuel (micro-entrepreneur), registered under SIRET 91299026400018, located at 11 Rue de Poitou, 75003 Paris, France (hereinafter "EVA MEMENTOS").
By placing an order, you acknowledge that you have read and accepted these Terms of Sale. These CGV prevail over any other general or specific conditions not expressly approved by EVA MEMENTOS.
Article 1 — Products
EVA MEMENTOS offers a curated collection of scented soy candles, handmade in France. Product descriptions and photographs are provided with the greatest possible accuracy. However, minor variations inherent to artisanal production do not constitute defects.
Article 2 — Prices
All prices are set in euros (€). Depending on your location, prices may be displayed and charged in your local currency. Local currency amounts are converted by our payment provider at the time of purchase and may vary due to exchange rate fluctuations. The price in euros remains the reference price.
TVA non applicable — article 293 B du Code Général des Impôts.
Shipping costs, if applicable, are displayed separately at checkout before order confirmation. Prices may be modified at any time, but orders are invoiced at the price in effect at the time of purchase.
Article 3 — Ordering
To place an order, select your product(s), proceed to checkout, enter your shipping and billing information, and confirm payment.
An order is considered binding once payment has been successfully processed. EVA MEMENTOS will send a confirmation email summarizing the order details.
EVA MEMENTOS reserves the right to refuse or cancel any order in cases of suspected fraud, pricing error, stock unavailability, or abnormal purchasing activity.
Article 4 — Payment
Payment is due at the time of order. Accepted payment methods are indicated at checkout and are processed securely through Shopify Payments and/or third-party payment providers.
Article 5 — Shipping and delivery
Orders are processed within 2–3 business days. Delivery times vary depending on destination and carrier. Full details are provided in our Shipping Policy.
Risk of loss transfers to the customer upon delivery of the product to the carrier. However, in accordance with Article L. 216-4 of the French Consumer Code, EVA MEMENTOS remains responsible for the product until it is received by the customer when the carrier is arranged by EVA MEMENTOS.
Article 6 — Right of withdrawal
In accordance with Articles L. 221-18 to L. 221-28 of the French Consumer Code, customers within the European Union have the right to withdraw from their purchase within 14 days of receiving the order, without providing any reason.
To exercise this right, you must notify EVA MEMENTOS within the withdrawal period by submitting a return request through your customer account or by contacting contact@evamementos.com.
The product must be returned unused, unburned, in its original condition and packaging. Return shipping costs are the responsibility of the customer, unless the product is defective or incorrect.
Refunds are issued to the original payment method within 14 days of receiving the returned product, subject to inspection.
Products that have been used, burned, or are not returned in their original condition are excluded from the right of withdrawal.
Article 7 — Legal guarantees
All products sold by EVA MEMENTOS benefit from the legal guarantee of conformity (Articles L. 217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
If a product is found to be non-conforming or defective, the customer may contact EVA MEMENTOS at contact@evamementos.com with photos and a description of the issue. EVA MEMENTOS will arrange for replacement or refund in accordance with applicable law.
Article 8 — Liability
EVA MEMENTOS shall not be held liable for damages resulting from misuse of the products, non-compliance with usage instructions, or events of force majeure.
Candles are flammable products. Customers are responsible for following all safety instructions provided with the product.
Article 9 — Personal data
Personal data collected during the ordering process is used solely for order processing, delivery, and customer communication. Data is handled in accordance with our Privacy Policy and Regulation (EU) 2016/679 (GDPR).
Article 10 — Applicable law and disputes
These Terms of Sale are governed by French law.
In the event of a dispute, the customer is invited to contact EVA MEMENTOS first to seek an amicable resolution. If no agreement is reached, the customer may refer the matter to a consumer mediator in accordance with Articles L. 611-1 et seq. of the French Consumer Code.

Any litigation arising from the application of these Terms of Sale falls under the jurisdiction of the competent courts of Paris, subject to mandatory consumer protection provisions.
